Ministry of Public Security: Cutting off the interest chain can completely eliminate the "yellow" source of the network.
● In the process of handling cases, we often receive reports from ordinary people, but after investigation, we found that although some pictures look "yellow", they can only be regarded as pornography. For pornography, we can’t deal with it according to criminal law, and even it is difficult to deal with it according to public security cases. It is precisely because there is no explicit provision on pornography in the law that some websites, forums and blogs take the opportunity to play the "edge ball".
● Another hurdle to completely eradicate online obscenity and pornography is how to cut off the interest chain of criminals. Cut the chain of interests, and the pornographic information on the Internet will be like cutting leeks, and it will be difficult to get rid of the roots.
Liu Ming (a pseudonym), a 17-year-old high school student, was originally excellent in academic performance, and attending a key university is just around the corner. However, by chance, Liu Ming broke into the "forbidden zone" of the network. Under the poison of naked obscene performances, he raped Tingting, an 8-year-old girl from his neighbor’s house, many times.
The favored son of heaven, who is about to enter the ivory tower, was finally mired in online obscenity and pornography, and received a verdict of three years’ imprisonment from the court of Kashgar Reclamation Area of Xinjiang Corps.
The relevant person in charge of the Internet Security Management Office of the Public Information Network Security Supervision Bureau of the Ministry of Public Security said in an interview with reporters today that the development and spread of harmful information such as online obscenity and pornography have brought serious harm to the masses, especially teenagers. To some extent, online obscene pornographic information is a booster for teenagers to embark on the road of crime and one of the important incentives.
Obscene pornographic information has been significantly reduced.
According to reports, 13 ministries and commissions, including the Ministry of Public Security, the Ministry of Information Industry and the General Administration of Press and Publication, launched a nationwide special campaign to crack down on harmful information such as online obscenity and pornography according to law from January to October this year. Up to now, it has been found that more than 2.4 million pieces of illegal and harmful information on the domestic Internet have been cleared, and more than 20,000 illegal websites and online information service columns have been closed. Among them, there are more than 1.6 million obscene and pornographic information. Local public security organs have also cracked more than 420 cases of obscenity and pornography.
"Search engines are the first gateway for many netizens to access the Internet. Holding this gateway will also block the’ throat’ of online obscenity and pornography." The person in charge said.
According to reports, Beijing public security organs organized Baidu, Google, Yahoo and other units to carry out centralized clean-up and rectification of search engines. In a short week, 154 million harmful information pages were blocked, more than 7 million harmful information links were removed, and 1.53 million obscene and pornographic pictures were deleted.
"We have technically filtered harmful information such as obscenity and pornography to ensure that the influence of bad information is eliminated from the source. At the same time, we have also strengthened network supervision and cracked a number of typical major cases." The person in charge told reporters.
In January 2008, the public security organs in Xuzhou City, Jiangsu Province cracked a case in which love figure Park, with a physical address in the United States and more than 200,000 members, spread obscene articles for profit, and successively moved to Liaoning, Hubei, Henan and other places to arrest six suspects, including Xie.
In March 2008, police in Zhuhai, Guangdong, busted a criminal gang that used the Internet to organize cross-border pornographic performances, destroyed 22 dens of obscene pornographic performances set up by the gang in Zhuhai, and arrested 13 suspects suspected of organizing obscene pornographic performances, involving nearly 30 million RMB.
The person in charge said that after 10 months of joint crackdown and rectification by multiple departments, the obscene pornographic information on the Internet in China has been significantly reduced, and it has been difficult for netizens to find websites that post obscene information naked.
Internet pornography exploited legal loopholes.
Although in recent years, the Ministry of Public Security and other relevant departments have launched a special campaign to crack down on harmful information such as online obscenity and pornography every year, after the action, some obscene and pornographic information remains, and even new information emerges constantly.
The person in charge gave the reporter an analysis of the deep-seated reasons for the repeated deletion of online obscenity and pornography.
"In the minds of many netizens, obscenity is equal to pornography, and the two are a concept. In fact, the two are very different in law. " The person in charge explained that according to the provisions of Article 367 of the Criminal Law, obscene articles refer to obscene books, films, video tapes, audio tapes, pictures and other obscene articles that specifically describe sexual behavior or openly promote pornography. Pornography has no relevant definition in law.
"In the process of handling cases, we often receive reports from ordinary people, but after investigation, we found that although some pictures have bare backs and thighs and look very’ yellow’, they can only be regarded as pornography." The person in charge said, "For pornography, we can’t deal with it according to the criminal law, and even it is difficult to deal with it according to public security cases."
The reporter learned that it is precisely because there is no explicit provision on pornography in the law that some websites, forums and blogs took the opportunity to play the "edge ball". Individual small and medium-sized websites publish a large number of pictures, words and audio-visual information with vulgar content and low style to attract netizens and increase website popularity and income.
"These pornographic information are more harmful to teenagers than obscene information." The person in charge analyzed that these provocative pictures can even induce some teenagers to go to the road of no return.
Only by cutting off the interest chain can the roots be eradicated.
Another hurdle that needs to be crossed in order to completely eradicate online obscenity and pornography is how to cut off the interest chain of criminals. The person in charge told the reporter that at present, many criminals are abroad or transfer their servers overseas. When the public security organs take action, they can only get rid of the downline and the messenger, and it is difficult to destroy the entire obscene network.
"Without breaking the interest chain of criminals, online obscene pornographic information will be like cutting leeks, and it will be difficult to get rid of the roots." The person in charge said with some regret that adult pornographic websites are legal in foreign countries, such as the United States and Japan.
In addition, the network obscenity and pornography crimes are gradually hidden and underground. In recent years, with the rise of paid online literature, some "writers" deliberately add obscene content to their works to attract netizens to browse and increase the number of clicks.
"These obscene information are generally mixed in the depths of the text of the article, and they can’t be found at all from the homepage and the beginning of the website. They are very camouflage." The person in charge said that this has objectively increased the difficulty of cracking down.
"Internet obscene pornographic information can’t be cracked down by public security organs alone. It also needs the public, including the majority of netizens, to jointly resist the bad trend of online vulgarity. Only through website self-discipline and netizens’ awareness of law-abiding can we really clean up the dirt on the Internet." The person in charge said. (Reporter Wei Xu)
